This question was raised after photos and video clips circulated online showing Ivler partying, with liquor and unidentified women present inside the jail.
Some of the photos show Ivler, who is accused of killing Renato Victor Ebarle Jr. in 2009, with his family.
However, other photos and video clips show him having a drinking session with people, including women.
The Ebarle family’s lawyer, Atty. Amelita Garayblas, said the incidents violate jail regulations.
"We were very much surprised because an inmate... can enjoy such perks in his cell," she said.
They are now asking the court to order the transfer of Ivler to the Bicutan detention center at Camp Bagong Diwa.
Mom claims prison a ‘party place’
Ivler's mother, on the other hand, defended her son.
Marlene Aguilar-Pollard described the jail as a “party place” and claimed that the practice regularly happens in other detention centers in the country.
"Kultura na po ng jail iyan sa Pilipinas [It's jail culture in the Philippines]," she said.
She said gang members inside jail invite her son to join them in parties.
“Hari ng selda ang anak ko! Mga Sputnik, Bahala Na Gang, laging inaaya ang anak ko. Sikat na sikat siya doon. Pina-tattoo pa nila mukha ng anak ko sa katawan nila,” she claimed.
She also described her son as "Jason Ivler ng bayan."
Aguilar-Pollard added that “busloads of women” regularly visit her son.
"Kung ano man ang binebentang treatment doon, kahit sex pa iyon, I'll pay for it," she added.
Quezon City jail authorities have yet to comment on the issue.
Jail official denies VIP treatment
Bureau of Jail Management and Penology (BJMP) official Rosendo Dial denied any special treatment being given to Ivler.
"Lahat po ng inmates ay nag-oobserve ng policy. Wala pong exemption," he said in an interview on Thursday on ANC’s The Rundown.
He said people can visit inmates. "Actually, puwede naman po iyung dumalaw, bawal iyung inuman."
Dial, however, said visitors should only be immediate relatives and friends. "Dapat pagpasok pa lamang nila, kinukuha na iyung pangalan. Ika-countercheck po iyan," he said.
He added that visitors who are not on a master list will not be allowed inside the jail.
Dial said he watched the TV Patrol report and did not see any irregularities among the photos and video clips shown on air.
"Napanood ko po kanina iyung palabas. Wala naman po kaming nakitang nakikipag-inuman siya," he said.
He added that visitors of inmates at the Quezon City jail are allowed inside detention cells because the facility is cramped. "Iyung QC jail po kasi ay napakasikip. Pinapayagan pong lumapit iyung bibisita. Wala na pong visiting area."
He, however, vowed to have the issue investigated. "Iimbestigahan po natin iyan. Iyung selda po niya, hindi po kasi siya nag-iisa doon. Napakaimposible po kasi kung may mangyayari doon."
He also expressed doubts that other inmates look up to Ivler. "Bakit naman siya iidolohin sa loob?”
Dial said inmates are sometimes impressed by some fellow detainees who speak English well. ”Kapag medyo nag-iingles, tinitignan siya ng mga inmate," he said.
On Ivler’s mom
Dial also scoffed at claims made by Ivler’s mother.
"Parang iyung mother niya, wala sa sarili magsalita. Tingin namin, sobrang kayabangan na lang ang kaniyang pagsasalita," he said.
He added that Aguilar-Pollard also verbally abuses jail guards. "Mataray kasi iyan. nagbubunganga sa mga guwardiya. Iyan po ang sumbong sa akin ng mga guwardiya sa QC jail."
Dial said it does not matter if Ivler remains in the Quezon City jail or is transferred to another detention facility. "Parehas naman po ang treatment sa kaniya doon.”
